Charlie Kirk's widow and parents will attend a preliminary hearing next week where prosecutors plan to lay out their case against the man accused of murdering the conservative activist during a public event at Utah Valley University last September.
The hearing begins July 6. Tyler James Robinson, 23, faces aggravated murder charges in connection with Kirk's death. The proceeding will mark the first time the family confronts Robinson in court.
Erika Kirk, who took over leadership of Turning Point USA after her husband's death, is expected to sit alongside Kirk's parents, Robert and Kathryn Kirk, throughout the week's proceedings. Despite telling mourners at his memorial service that she forgives Robinson, Erika has fought to keep the courtroom doors open to public scrutiny.
A preliminary hearing serves a specific legal function: prosecutors must demonstrate probable cause that a crime occurred and that the defendant committed it to advance the case toward trial. Robinson has not yet entered a plea.
The state's case relies on substantial forensic evidence. DNA matching Robinson's profile was recovered from the rifle's trigger, the spent cartridge casing, two unfired rounds, and a towel used to wrap the weapon. Prosecutors also plan to present surveillance footage, witness recordings, autopsy results, and what they describe as incriminating messages from Robinson.
Perhaps most damaging is a note Robinson allegedly left for his romantic partner stating: "I had the opportunity to take out Charlie Kirk and I'm going to take it."
Kirk was shot in the neck on September 10 while debating opponents before thousands of attendees at the university. The shooting stunned the conservative movement and set off a major criminal investigation that culminated in Robinson's arrest.
If prosecutors convince the judge that probable cause exists, Robinson will proceed to trial. The state has signaled its intent to seek the death penalty should he be convicted.
