FBI Director Patel sues Atlantic for $250M over drinking allegations story

Kash Patel has filed a defamation lawsuit against the Atlantic and reporter Sarah Fitzpatrick, seeking $250 million in damages over an article published in April that detailed allegations of excessive drinking and unexplained absences during his tenure at the FBI.

The complaint, filed in U.S. District Court for the District of Columbia, characterizes the story as a "sweeping, malicious and defamatory hit piece" designed to destroy Patel's reputation and force him from office. The lawsuit argues that the Atlantic and Fitzpatrick crossed a legal line by publishing claims that Patel's team says are false and fabricated.

Patel's legal team, led by lawyer Jesse R Binnall, claims the magazine acted with actual malice, the legal standard required to win a defamation case against a public figure. The complaint also alleges that the Atlantic denied the allegations when given advance notice and failed to provide sufficient time for Patel to respond before publication.

"Fitzpatrick could not get a single person to go on the record in defense of these outrageous allegations, instead relying entirely on anonymous sources she knew to be both highly partisan with an ax to grind and also not in a position to know the facts," the lawsuit states.

The Atlantic's April article cited six current and former officials who reported that meetings and briefings had to be rescheduled due to Patel's "alcohol-fueled nights" early in his FBI tenure. Patel had publicly warned of legal action before publication, telling Fitzpatrick to "print it, all false, I'll see you in court, bring your checkbook."

The magazine has shown no signs of backing down. Atlantic Editor-in-Chief Jeffrey Goldberg issued a statement affirming support for the reporting, while Fitzpatrick told MSNBC anchor Jen Psaki that she stands by every word. "The Atlantic is nothing but diligent," Fitzpatrick said. "We have amazing lawyers, amazing editors."

A spokesperson for the Atlantic doubled down, stating: "We stand by our reporting on Kash Patel, and we will vigorously defend the Atlantic and our journalists against this meritless lawsuit."

The lawsuit marks the latest escalation in tensions between the Trump administration and major media outlets, with legal challenges flowing in multiple directions. Binnall framed the action as a matter of accountability, writing on X that "defamatory speech is not free speech."
